Protection of Personal Information

To facilitate the smooth performance of our business operations, we at TOKYU CONSTRUCTION CO., LTD. acquire and use information about our customers that can identify the individual customer, or that can easily be used in combination with other information to identify the individual customer, including the customer’s name, date of birth, address, telephone number, and e-mail address, as well as information containing the customer’s individual identification code (hereinafter, collectively “personal information”). We acknowledge that it is our great responsibility to protect personal information properly, and we hereby agree to handle personal information pursuant to the policy indicated below.

1. How we intend to protect personal information (Privacy Policy)

  1. We shall adhere to the Act on the Protection of Personal Information and other related laws and regulations applicable to personal information. In addition, we shall handle personal information properly and in conformity with practices which concern the handling of personal information and which are generally accepted as fair and appropriate. Furthermore, we shall make efforts to improve our handling procedures as necessary.
  2. In addition to formulating internal regulations concerning the handling of personal information, we shall provide education and training on the protection of personal information to employees so as to familiarize our employees with the content of the internal regulations. We shall also request our business partners and the like to handle personal information properly.
  3. Upon acquiring personal information, we shall specify the purpose of use and issue a notification or make an announcement to that effect, and we shall handle personal information pursuant to such purpose of use.
  4. In order to prevent divulgation, loss, falsification, or the like of personal information, we shall take necessary measures to properly manage personal information.
  5. If a customer requests for disclosure, correction, deletion, or discontinuation of use of personal information held by TOKYU CONSTRUCTION CO., LTD., we shall promptly handle such request in a reasonable manner within the extent required.

Specifically, we shall handle personal information pursuant to the details below.

2. Purposes of use, etc.

Although we acquire personal information which is required for performance of our business operations in light of our business purposes as set forth in our Articles of Incorporation, we shall use such personal information for the following purposes. Furthermore, in the event of using personal information for purposes other than those indicated below, we shall obtain the consent of the person who provided such personal information (hereinafter, the “person concerned”) beforehand, except in cases in which such use is stipulated in laws and regulations.
In addition, we may outsource to our contractors a part of our business operations to facilitate the smooth performance of our business operations, and provide personal information to such contractors within the scope that may be required. When doing so, we shall supervise such contractors properly, primarily by concluding with each of such contractors an agreement containing provisions related to the handling of personal information.

  1. Performance of sales activities targeting clients (including prospective clients); fulfillment of contracts with clients; and performance of duties related or incidental to the foregoing (including after-sales services or consultancy services).
  2. Order placement and outsourcing to contractors and the like for civil engineering and building construction-related purposes such as contracting (including subcontracting), investigation, construction planning, measurement, design, and management, procurement of materials and equipment, and provision of services; sale, lease, maintenance, inspection of, and after-sales services involving civil engineering and building construction machinery, appliances, equipment, and products, and performance of duties related or incidental to the foregoing.
  3. Performance of duties that are necessary for the company’s business activities and that are intended for neighborhood residents, land owners, and the like including explaining construction and business, as well as acquiring consent from such persons.
  4. Maintenance and supervision of buildings and structures; sale, lease, and intermediation of real estate; and performance of duties related or incidental to the foregoing.
  5. Performance of duties that are related or incidental to outsourcing or the like with the purpose of record keeping and storage, concerning the properties for which the company conducted business operations, such as properties constructed, properties designed, and properties sold.
  6. Order placement and outsourcing to contractors and the like for purposes in the ICT and IoT fields (computers, electronics, telecommunications equipment, etc.) comprising planning, development, sale, provision of services, lease, maintenance, and consultancy services; and performance of duties related or incidental to the foregoing.
  7. Performance of duties related or incidental to investigation, planning, sale of equipment, lease, maintenance and consultancy services for environmental improvement together with energy measures service (such as power generation, and supply of electricity and heat business) for carbon emission trading and renewable energy.
  8. Business related to the restoration of polluted environments through methods such as soil and water purification, and performance of duties related or incidental to the development, design, sale, and implementation of equipment and systems for disaster prevention.
  9. Performance of duties related or incidental to the sale of railway rolling stock, and production, processing, and sale of agricultural products, and manufacture and sale of agricultural materials.
  10. Performance of PR activities inside and outside the company, and duties related or incidental to the foregoing.
  11. Activities related to our business by outside organizations, and performance of duties related or incidental to the foregoing.
  12. Contact with persons who enter our premises or who contact us by telephone, fax, e-mail, or the like.
  13. Recruiting activities by the company, and performance of duties related or incidental to the foregoing.
  14. Fulfillment of contracts with the company’s contract workers, temporary workers, and the like; and clerical work involved in the foregoing.
  15. Clerical work for social insurance programs, etc., welfare programs, and the like for the company’s officers, employees, advisors, and the like, as well as the families of the aforementioned persons.
  16. Performance of duties that are necessary for shareholders to properly exercise their rights.
  17. Communication between the company and the company’s group companies (both inside and outside Japan); the company’s management of performance of the company’s group companies; and performance of duties related or incidental to the foregoing.
  18. Research and development for our existing business and new business, and performance of duties related or incidental to the foregoing.
  19. Performance of duties related or incidental to any of the above.
  20. Provision of personal information to third parties within the scope required for achieving the purposes of use described above.

3. Disclosure and provision to third parties

The company shall not disclose or provide personal information to a third party other than to provide personal information to a third party within the scope necessary for achieving the purposes of use indicated in “2. Purposes of use, etc.,” to provide personal information to the contractors indicated in “2. Purposes of use, etc.,” and in any of the cases below.

  1. Cases in which the person concerned has given his/her consent.
  2. Cases in which personal information is disclosed or provided in a manner that makes it impossible to identify the person concerned, such as in the form of statistical data and the like.
  3. Cases in which disclosure or provision of personal information is required by laws and regulations.
  4. Cases in which disclosure or provision of personal information is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the person concerned.
  5. Cases in which disclosure or provision of personal information is especially necessary for improving public health or promoting the sound growth of children, and in which it is difficult to obtain the consent of the person concerned.
  6. Cases in which disclosure or provision of personal information is necessary for cooperating with a state organ, a local government, or the like in performing the affairs prescribed by laws and regulations, and in which obtaining the consent of the person concerned is likely to impede the performance of the affairs.

We at TOKYU CONSTRUCTION CO., LTD. make available, for shared use, personal information on the Kensetsu-Site Series, an application service provider (ASP) service for the construction industry operated by MC Data Plus, Inc.
For the items of personal information that are subjected to shared use, the range of persons involved in the shared use, and the purposes of use on the Kensetsu-Site Series, please refer to “Shared use of personal information on the Kensetsu-Site Series.”

5. Contents of safety management measures

We shall endeavor to continuously take necessary and appropriate safety measures against the risk of unauthorized access to and leakage of, loss of, or damage to personal information. Specifically, we shall take the following measures, among others.

  1. Organizational safety management measures

    • Establishment of organizational structure for the protection of personal information
    • Establishment of regulations, etc. that stipulate the protection of personal information and operation in accordance with the regulations, etc.
  2. Human safety management measures

    • Education on personal information protection for employees, etc.
  3. Physical safety management measures

    • Management of areas where personal information is handled
    • Physical protection of equipment/devices, prevention of theft, etc.

    • Access control of systems that handle personal information
    • Prevention of unauthorized access from the outside to systems that handle personal information

    • When handling personal data in a foreign country, we investigate and understand the regulations related to the protection of personal information in such foreign country, and take appropriate safety management measures.

6. Notification to the person concerned

If, with respect to the personal data held by the company, a person requests for notification of the purpose of use of the personal data which is held by the company and which can identify the person concerned, we shall respond, after verifying the identity of the person making the request, within a reasonable time and to a reasonable extent, except in the cases 1. through 4. below.

  1. Cases in which the purpose of use of the personal data which is held by the company and which can identify the person concerned is evident.
  2. Cases in which the notification has a risk of harming the life, body, property, or any other rights and interests of the person concerned or a third party.
  3. Cases in which the notification has a risk of harming the company’s rights or interests.
  4. Cases in which cooperation is required for the performance of affairs by a state organ or local government as stipulated by laws and regulations, and in which the notification is likely to impede the performance of the affairs.

7. Disclosure to the person concerned

With respect to the personal data held by the company, if a person requests to have the data about him/herself disclosed, we shall respond, after verifying the identity of the person making the request, within a reasonable time and to a reasonable extent, by issuing a written document (or any other method if so agreed with the person concerned). We may restrict the content of the personal data to be disclosed in cases in which such disclosure has a risk of harming the life, body, property, or other rights and interests of the person concerned or a third party, or in cases in which there is a risk of significant impediment to the proper implementation of the company’s business operations, or in other cases in which such disclosure may violate laws and regulations.

8. Correction and deletion, etc.

With respect to the personal data held by the company, if a person requests to make corrections or additions to, or delete, the data about him/herself, we shall handle such request concerning the correction, addition or deletion of the data, after verifying the identity of the person making such request, within a reasonable time and to a reasonable extent.
With respect to the information held by the company in accordance with relevant laws and regulations, we may not respond request for correction, deletion, etc.

9. Discontinuation of use, etc.

With respect to the personal data held by the company, if a person requests for discontinuation of the use, deletion, or discontinuation of the provision to a third party of information about him/herself (hereinafter, “discontinuation of use, etc.”), we shall handle such request after verifying the identity of the person making such request, by effecting the discontinuation of use, etc. within a reasonable time and to a reasonable extent, except for information that is held without violating the relevant laws and regulations.
After discontinuation of use, etc. of such information in part or in its entirety, we may not be able to provide some of our services.

The requests indicated in the above Sections 6, 7, 8, and 9 concerning personal data held by the company as well as other inquiries concerning personal information are accepted by the following method. If your request is not conformed to such method, we may not accept your request.

We verify the identity of the person making the request, and then respond by issuing a written document or by some other method.     If you are inquiring about your own information, we verify your identity by a driver’s license, passport, health insurance card, seal registration certificate, or other such supporting documentation.
    If an agent is inquiring about your information on your behalf, we verify the agent’s authority by a power of attorney and a seal registration certificate for the stamp which is placed on the power of attorney.

  2. Fees
    Upon disclosure or notification of personal information, we ask for a fee of 1,000 yen (tax included) per case, payable by postal money orders or postage stamps. Please send your payment along with your request for disclosure of information.
    If you plan to send us postal money orders, please do not fill out the columns for the recipient’s address and name.

11. Revision to the Privacy Policy

We may review our Privacy Policy from time to time and make changes thereto as needed. In such a case, the revised Privacy Policy shall be applicable from the date on which the revised version is made public.
